Welcome to By the Sea Rentals!
These terms and conditions outline the rules and regulations for the use of By the Sea Rentals' Website, located at www.bythesearrentals.com.
By reserving a stay on our website, you hereby agree to the following conditions:
Reservation Agreement:
1. STAY of this Reservation shall begin on and end on the said dates in the booking reservation. The property will be ready for occupancy at 3:00 pm on the beginning date of the Reservation and must be vacated by 10:00 AM on the ending date of the Reservation. No extension of term.
2. PREMISES is located at the address posted in the listing.
3. ACCOMMODATE FARE: $______________USD. Rent (as posted in the reservation) is due 30 days prior to arrival or at time of booking if less than 30 days prior to arrival.
4. DAMAGE PROTECTION: Guest has agreed to purchase damage protection for coverage in the amount of $1,500; $3000 or $8,000 depending on the property.
5. CLEANING FEE is due 30 days prior to arrival or at time of booking if less than 30 days prior to arrival.
6. UTILITIES provided are: water, heat, electricity, trash removal, cable television, Wi-Fi. These utilities are paid for by Property Manager. Guest agrees not order any Pay Per View items on the TV without prior approval.
7. RESTRICTIONS: No smoking (anywhere on the property), no illegal drug use. Violation of this restriction will cause immediate termination of Reservation. Guests will be required to depart immediately and forfeit any remain time and deposit. If you are renting a pet friendly property, prior permission must be made. Pet fee is: $200 per pet. You agree to take your pet off property to do their “business” and to properly clean up and dispose of the waste. If neighbors complain of barking dog, you will be asked to either keep your dog with you at all times or depart the property.
8. SPA/FIREPIT/BBQ: If you are renting a property that is equipped with a Jacuzzi Spa, gas Firepit and or gas BBQ, Guest agrees to use care when operating and closely supervise any children. All non-swimmers and children under the age of 12 to be closely watched. Guest is made aware there are no alarms on the doors to the backyard. Use of any or all of these features are at Guests own risk.
9. MAXIMUM NUMBER OF OCCUPANTS: The house is to be occupied by no more than posted number of persons on the listing.
10. GUEST assures PROPERTY MANAGER that the Guests will observe all conditions and terms of this Reservation as maintaining the premises in good order and appearance and will conduct themselves in a manner non-offensive to neighbors. Guest acknowledges and agrees to abide to the “Good Neighbor” policy with quite hours from 10PM to 7AM. Socializing to be brought indoors during these hours. Guest assures the Property Manager there will be no events, parties, gatherings to occur on the property. Use is for the registered guests.
11. GUEST assures the PROPERTY MANAGER that any Guest who violates any of the terms of the Reservation shall be immediately denied occupancy and shall remedy any damages or other expenses which are caused by the Guest and/or the Guest’s guest(s).
12. GUEST agrees that during the term of this Reservation that he/she occupies the premises, he/she will keep the reserved premises clean and free of trash, garbage, and other waste. All pipes, wires, glass, plumbing and other equipment, locks, fixtures and walls are to be kept in the same condition as at the beginning of the Reservation. Reasonable wear and tear and damage by unavoidable fire and casualty are the only exceptions.
13. GUEST agrees in indemnify and save PROPERTY MANAGER and OWNER harmless from all liability, loss or damage arising from any illness, nuisance, harm made or suffered on the reserved premises by the GUEST, or Guest’s guest(s) or from any carelessness, neglect, or improper conduct of any persons entering, occupying or visiting the Reserved premises. This property has been previously occupied, while every effort is made to ensure cleanliness, guest is staying at their own risk.
14. ENTERING THE PREMISES. PROPERTY MANAGER or his agent must give GUEST a minimum of 24 hour notice (or a mutually agreed upon time) to enter the property to make necessary repairs. In an emergency, PROPERTY MANAGER or his agent may enter the premises at any time without securing prior permission from GUEST.
15. SUBLET. GUEST may not let, sublet; assign this Reservation for all or any part of the premise.
16. If GUEST abandons or vacates the premises, PROPERTY MANAGER may at his option terminate this Reservation, enter the premises, and remove all property.
17. TERMINATION: Either party may terminate this Reservation in the event of a violation of the provisions of this Reservation, or as provided by law.
18. CANCELLATION: Cancellation of this Reservation must be accompanied with a 30 day written notice to receive full refund. Refund of 50% rent if cancelled less than 30 days in advance. No refund of rent if cancelled less than 7 days in advance of occupancy; cleaning fee will be returned if cancellation occurs. We do not refund for natural disasters, beach closures, illness, government lockdowns or restrictions. Consider purchasing trip insurance if you have concerns. If payment has already been processed, NO REFUND OF CREDIT CARD PROCESSING FEE.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: “Client”, “You” and “Your” refers to you, the person log on this website and compliant to the Company's terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client's needs in respect of provision of the Company's stated services, in accordance with and subject to, the law. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to the same.

Unless otherwise stated, By the Sea Rentals and/or its licensors own the intellectual property rights for all material on By the Sea Rentals.
All intellectual property rights are reserved. You may access this from By the Sea Rentals for your own personal use subjected to restrictions set in these terms and conditions.
You must not:
- Republish material from By the Sea Rentals
- Sell, rent or sub-license material from By the Sear Rentals
- Reproduce, duplicate or copy material from By the Sea Rentals
- Redistribute content from By the Sea Rentals
This Agreement shall begin on the date hereof.
Parts of this website offer an opportunity for users to post and exchange opinions and information in certain areas of the website. By the Sea Rentals does not filter, edit, publish or review Comments prior to their presence on the website.
Comments do not reflect the views and opinions of By the Sea Rentals,its agents and/or affiliates. Comments reflect the views and opinions of the person who posts their views and opinions.
